1 Terms of use

1.1 Location of the Website

Escalade Bliss S.E.N.C. is registered in Quebec, Canada. Escalade Bliss makes no representations that elements of the Site may be used in other locations than Canada and it is prohibited to access the Site from territories where legislation would require that the content or use of the Site is illegal. Those who choose to use the Site do so on their own initiative and it is their responsibility to comply with all applicable local laws. Any claim relating to the Site and the elements it contains, or arising from the use of the Site, is governed by the laws applicable on the territory of the province of Quebec in Canada.

1.2 Restrictions on use

Unless otherwise specified in any section of the Site, no element of the Site may be copied, reproduced, distributed, published, translated, downloaded, displayed or transmitted in any way without prior permission, written by Escalade Bliss SENC

1.3 Trademarks

The trademarks and logos used or displayed on the Site are registered or unregistered trademarks of Escalade Bliss S.E.N.C. Nothing in the Site may be interpreted to permit, directly or indirectly, the use of a trademark reproduced on the Site without the prior written permission of the owner of such trademark.

1.4.1 The Site does not provide medical advice

The content of the Site is informational only and is not intended to replace a professional opinion, diagnosis or medical treatment. You should never rule out or delay obtaining professional medical advice after reading information on the Site.

It is at your own risk that you trust any information provided by the Site, our instructors to appear on the Site, or by any other visitor to the Site (in comment in the blog if any).

1.4.2 The Site does not provide professional advice

Regarding the technical information you find on the Site, they are not intended to replace a professional opinion. Always obtain the advice and recognition of a qualified professional during in-person training. In addition, we strongly recommend that you read all the notices for the equipment you choose to use and to comply with the prescribed uses for each piece of equipment.

1.5 Limitation of liability

Subject to any public policy to the contrary, Escalade Bliss S.E.N.C disclaims any and all warranties, including warranties of merchantability or convenience for a particular purpose. You acknowledge, as a user of the Site, that all elements, information and opinions that you may transmit to Escalade Bliss SENC, in any way whatsoever, will become the sole and exclusive property of Escalade Bliss SENC and you renounce all moral right with regard to these elements. Escalade Bliss S.E.N.C informs you that it may, without any compensation for you, use, reproduce, publish, license, in any way and with anyone, the items you have transmitted to Escalade Bliss S.E.N.C. You are further prohibited from passing on to Escalade Bliss S.E.N.C anything that is unlawful, defamatory, obscene or contrary to any applicable law. By submitting to Escalade Bliss S.E.N.C content elements, you represent to Escalade Bliss S.E.N.C that you have all rights in them, whatever they may be, including intellectual property rights. Escalade Bliss S.E.N.C reserves the right not to publish or remove any item you have sent to Escalade Bliss S.E.N.C in its sole discretion for any reason whatsoever.

2 Terms of Sales

2.1 Accepting an order

The receipt of an order confirmation by e-mail does not automatically mean that Escalade Bliss S.E.N.C accepts the order and is not confirmation that Escalade Bliss S.E.N.C is committed to selling anything. Escalade Bliss S.E.N.C reserves the right, without further notice, to refuse to do business with any customer and / or to set a quantity limit for any item of an order. It may be necessary for Escalade Bliss S.E.N.C, at any time, to verify personal information before accepting any order. In particular, for In-person courses that Escalade Bliss S.E.N.C. is giving.  In this particular case, you must complete the pre-requisite conditions before participating, registering in a course or clinic or workshop. This is also valid for online courses for which we will not always check the data. We reserve the right to refuse or withdraw access to a user if we deem it dangerous for him to continue his training with us.

2.2 Price

The price payable for each product you order is the one appearing next to each product offered on the Site.

Shipping and delivery charges, and applicable sales taxes, are extra.

Escalade Bliss S.E.N.C reserves the right to modify at any time the price of products offered on the Site, without notice.

All prices are in Canadian dollars.

2.3 Product returns

You can return products to Escalade Bliss S.E.N.C at any time before 10th day following their reception to the following address: Escalade Bliss, 6451 rue du Bel Horizon, Val Morin, Quebec, Canada, J0T2R0. The products must be accompanied by the invoice and the order number. You must provide justification to Escalade Bliss S.E.N.C in such a case.

You will be responsible for shipping and risk for returned products (unless Escalade Bliss S.E.N.C. has not delivered the goods you ordered or delivered damaged or defective products to you, in which case Escalade Bliss S.E.N.C. will cover the costs and the risks, to the extent that you return the products through an economical postal service.) Please note that we do not refund products that have been removed from their original packaging or, in the case of books, when they are damaged or when the cover is folded, unless the products are defective. If an item is defective and returned within 30 days of its purchase, it will be exchanged for a new copy of that same product. For clothes, they must not have been worn or washed.

Upon receipt of returned products, Escalade Bliss S.E.N.C. will reimburse the amount disbursed except for delivery charges, by sending a check by mail as soon as possible, provided, however, that the returned goods have been returned by you and received by Escalade Bliss S.E.N.C. in the same condition as they were when they were delivered to you.

2.4 Product availability

In the event that Escalade Bliss S.E.N.C. should wait for one or more out of stock items to become available, it may be that your order is retained before being shipped.

Escalade Bliss S.E.N.C. does not guarantee in any case the availability of the products offered on the Site. If Escalade Bliss S.E.N.C. can not deliver any of the products you ordered due to a shortage, Escalade Bliss S.E.N.C. will notify you by e-mail when ordered products that were not in stock will become available. You will then have the following options:

• Request that the products be delivered to you, in which case a payment will be taken from your Paypal account or your check will be cashed, as the case may be, for these products, before the products are delivered to you;
• Refuse that you are given these products, in which case no payment will be taken from your Paypal account for these products or your check will be destroyed.

Escalade Bliss S.E.N.C. will never be responsible for any damage you may have suffered due to a shortage of stock.

2.5 Delivery of products

Escalade Bliss S.E.N.C. will deliver the products ordered by you to the address you have transmitted when placing your order.

Delivery charges correspond to a product ordered.

Delivery will be made by Escalade Bliss S.E.N.C. as soon as possible after the acceptance of your order.

You will become the owner of the products you ordered when delivered by Escalade Bliss S.E.N.C. to the transport company. From then on, you will be required to assume the risk and Escalade Bliss S.E.N.C. will not be responsible for their loss or destruction.

For any product delivered outside of Canada, you are responsible for all costs associated with customs clearance and any other costs associated with exporting outside of Canada.

The delivery of the products is subject to the rules of the delivery companies with which Escalade Bliss S.E.N.C. in this case, Canada Post, as well as the rules of any other company with which Escalade Bliss S.E.N.C. will be able to do business from time to time. In particular, you are subject to the rules concerning the signing of an acknowledgment of receipt of the products, if applicable. If you are away from where you asked Escalade Bliss S.E.N.C. to deliver the products to you, it will be your responsibility to recover the products according to the rules of the delivery company.

Escalade Bliss S.E.N.C. must have received full payment of the products that must be delivered to you before proceeding with their delivery.

2.6 Content subject to an individual subscription

Certain content and / or services of the Site may be offered to you provided that you register to a subscription. If you choose to purchase subscription-based content or services and send them to Escalade Bliss S.E.N.C. a request to this effect, you certify that you are at least 18 years old, that all the information you submit is accurate and truthful (including, inter alia, the number of your credit card and its expiry date), and that you you agree to pay all your subscription fees and any related taxes. You may cancel your subscription to any paid content and / or services at any time within ten (10) days of the date of purchase by contacting Escalade Bliss S.E.N.C. in order to be fully refunded. You will not be entitled to any refund if you cancel your subscription after this initial period of ten (10) days. Your subscription applies to you and your family members. You may not transfer your account name and password to third parties or allow them to use them, including your co-workers. Any broadcast of your account name and password may result in the cancellation of your subscription without any refund, with additional fees based on unauthorized use.

2.7 Responsibility

In the event that the responsibility of Escalade Bliss S.E.N.C. in your regard could be withheld, it will be limited to an amount of money equivalent to the price you paid for the returned products. Notwithstanding the foregoing, nothing in this section shall have the effect of limiting any right you may have as a consumer under any of the public policy laws that may be applicable in your case.

2.8 Force Majeure

Escalade Bliss S.E.N.C. will not be liable for the non-performance, in whole or in part, of any of its obligations to you, or any damages or losses that you may suffer, if the non-performance, damage or loss results from any force majeure or circumstance beyond his control.

3 Disclaimer, Limitation of Liability, Release and Compensation

Escalade Bliss S.E.N.C. makes every effort to ensure that your use of the Site is a useful and enjoyable experience, and that the Site offers you an easy and secure way to purchase products on the Internet. However, Escalade Bliss S.E.N.C. and its service providers (the “Providers”) are not responsible for your use of the Site. Therefore, the following provisions apply to your use of the Site:

You (and not Escalade Bliss S.E.N.C. or the Vendors) will bear all costs arising from any maintenance, repair or correction of any computer or other equipment resulting from your use of the Site.

4. Login names and passwords

It is only possible to access the Site’s accounts with a unique login name and password. The use of a password does not limit access by Escalade Bliss S.E.N.C. and its suppliers to password protected information.

Login names and passwords can not be shared. For security reasons, your login name and password must be kept confidential; you must not disclose it to anyone else or allow anyone else to use it, other than an authorized Escalade Bliss S.E.N.C. representative. And it is important that your password is not an easy one and it’s difficult to guess and it’s secret, you change it regularly and you always end the connection by performing the intended procedure.

All login names and passwords remain the property of Escalade Bliss S.E.N.C., who may cancel or suspend them at any time without notice to you or any other person and without liability to you or any other person. The security and confidentiality provided by passwords are not complete and can be bypassed. You use your password at your own risk.

5 Termination of this agreement and end of the Site

If you violate the provisions of this agreement, you will no longer be able to use the Site.

Escalade Bliss S.E.N.C. may, at its discretion, modify or suspend the Site or any portion thereof, or any of its options, or terminate it, permanently or temporarily, at any time for any reason whatsoever, without notifying you or notifying any other person and without incurring any liability to you or any other person.

Escalade Bliss S.E.N.C. may at any time and for any reason, with or without cause, in its sole discretion, suspend or withdraw on the spot, in whole or in part, your permission to use the Site and your password, without notifying you or notifying any other person or liability to you or any other person.

If Escalade Bliss S.E.N.C. or you terminate this agreement or if Escalade Bliss S.E.N.C. withdraw your permission to use the Site, for whatever reason, this agreement shall continue to apply and bind you with respect to your prior use of the Site, your purchases of products and services by you through the Site and any other related matter.
